Luxury condominium will not be able to expel the dog that killed ema or fine a resident, judge decides | Goiás

A court decision prevented the dog Alaska from being banned from the Aldeia do Vale condominium in Goiânia. According to the lawsuit, the animal belongs to one of the residents of the place and killed an emu, so the administration fined her owner R$ 6,200 and wanted the dog to be prevented from continuing to live in the place.

Faced with the attitude of the condominium, the resident filed a lawsuit in court to prevent Alaska from being expelled and to contest the fine. The requests were accepted by Judge Alessandra Gontijo do Amaral, on March 21, but the decision was only released this Tuesday (5).

The Associação dos Amigos do Residencial Aldeia do Vale (Saalva) informed, in a new letter sent on Wednesday (6), that “the application of the fine and the request for the removal of the bitch Alaska, of the Siberian Husky breed, are based on the statutory provisions of the association, whose objective is to ensure the well-being, safety and integrity of its members” (read in full at the end of the report).

According to the lawsuit, the pet got off the leash and would have barked at an emu, which was loose around the condominium. The document reports that the bird would have advanced and, to defend itself, Alaska retaliated and ended up killing the animal.

After the episode, the resident received a fine of R$ 6,239.77. The lawsuit states that, days later, there was a meeting of the board of the residents’ association in which they decided that Alaska could no longer live in the condominium.

The resident recorded that he was notified “to remove his dog from the association within five days, under penalty of taking the appropriate measures”.

In the lawsuit, the defense of the owner of Alaska attached photos and videos that show the dog being docile, arguing that the situation was punctual and that she does not represent a risk.

The Associação dos Amigos do Residencial Aldeia do Vale (SAALVA), responsible for the administration of the residence, makes it public to clarify that the application of the fine and the request for the removal of the bitch Alaska, of the Siberian Husky breed, are based on the statutory provisions of the association, whose objective is to ensure the well-being, safety and integrity of its associates (residents), fauna and flora; and taking into account that the act of violence practiced by the animal compromises the safety, health and peace of the other residents.

The rheas are an invaluable asset to the fauna of Aldeia do Vale. Saalva has a duty to protect them and apply the rules set out in its Bylaws, which prohibit the presence of animals with a history of violence, which is the case of the bitch Alaska.

It is noteworthy that Saalva did not file a lawsuit against the resident, but the opposite. The respective resident filed a Condominium Fine Annulment Action with Request for Early Guardianship, and the request for Early Emergency Guardianship was granted by the judge of the 19th Civil and Environmental Court of goiâniadetermining the suspension of the collection of the fine and the immediate suspension of the notification that imposed the removal of the animal, while the present action lasts. In being a preliminary decision, in which the merits of the matter have not yet been assessed and, as this is provisional, the decision may be changed!

Finally, it should be noted that Residencial Aldeia do Vale was not duly mentioned in the records of the Action brought against it, but will present the appropriate defense in the case, being available to the Justice to collaborate and provide all the necessary information.
